SCOPE

• The following constitute the Terms and Conditions applicable to CYCUBIX Training Courses, offered both in a Public or Private format (i.e. In-Company or Private Training Groups)
• By booking a Training Course you are agreeing to accept these Terms and Conditions.
• Please read these Terms and Conditions carefully.

BOOKINGS

• Individual bookings can be placed online by visiting our website http://www.cycubix.com/ and paying the corresponding fees by credit/debit card or PayPal.
• Bookings by organisations and individual bookings can also be placed by email to [email protected] or by phone to +353 01 477 3265. If you book by email or over the phone we will reserve a place for you in the Training Course until the Registration Deadline.
• If booking by email or phone, upon receipt of your booking to the selected Training Course, CYCUBIX will raise and issue an invoice to the address indicated.
• Booking can also be placed by means of a PO (Purchase Order). In case a PO is necessary, please tell us when making the booking.
• No booking is complete until payment in full of the event fees, or we confirm receipt and approval of your PO.
• Places are subject to availability.
• Without prior written consent, resale of a CYCUBIX Training Course to the general public is strictly prohibited

 PAYMENT

• Invoice is due by Registration Deadline. Where a PO has been issued, payment terms are 30 days from date of invoice.
• Payment can be made by credit/debit card, bank transfer or PayPal.

• All major credit and debit cards are accepted. If details are not entered accurately (including type of card and number) or if the credit card company does not authorise payment, booking will be void. CYCUBIX will not accept any liability for costs incurred as a result of bookings voided in this manner.
• Sales taxes (i.e. VAT) are charged at the applicable rate depending on the product and/or customer.
• We cannot accept payment by instalments.
• CYCUBIX reserves the right to charge late payment interest on any outstanding invoice at the rate of 5% above the base rate of the European Central Bank at that time.

PRICING

• CYCUBIX will attempt to give notice of new pricing in advance, but CYCUBIX reserves the right to change listed prices without notice.
• Where a price quote is provided, it is only valid for the period specified in the quote.

DISCOUNTS

From time to time CYCUBIX may offer different discounts for our courses (i.e. early bird discounts, to people who subscribed to our newsletter, group discounts, members of industry/ cybersecurity/ education bodies, etc.)

• Discount codes must be entered at the time of booking, as the discount cannot be applied retrospectively.
• If a Participant would like to avail of a discount offered to members of a specific industry/cybersecurity/education body they may be required to provide evidence of their active membership.
• Group discounts apply to Participants booked at the same time, by the same organisation on the same Training Course.
• Discount/s only apply to the specific Training Course it has been offered for.
• Only one discount offer can be used per registration.

CANCELLATIONS, TRANSFERS AND SUBSTITUTIONS BY PARTICIPANTS

The following terms apply to the cancellations, transfers and substitutions by a Participant of his/her choice of Training Course:

• A Participant who wishes to cancel their registration for a course must do so in writing (by email or letter) to CYCUBIX.
• Where a Participant transfers his/her booking to another course, the Participant will not be entitled to any refund.
• Only one transfer is permitted per course per Participant.
• (*) If a Participant misses one or more days of a multi-day course due to an emergency we may decide, depending on the circumstances, to offer a place in the same course in the future.

PRIVATE TRAINING COURSES

• Private trainings are only confirmed upon full Payment or a confirmed PO, and no later than 15 working days in advance of the selected date.
• In case an organisation needs to cancel or postpone a Private Training Course, request must be sent in writing (letter or email) to CYCUBIX.
• No refund will be offered for a cancellation made within 15 or fewer working days immediately prior to the scheduled start date of the training course. In that event the full sum shown on the invoice remains payable.
• Where a minimum number of attendees has been specified for a session, if numbers drop below that minimum within 15 or fewer working days immediately prior to the scheduled start date of the training course, the organisation may choose for the course to be run with the reduced number of attendees, but the full sum shown on the invoice shall remain payable.

CHANGES AND/ OR CANCELLATIONS BY CYCUBIX

• Where reasonably necessary, CYCUBIX reserves the right to alter published programmes, fees, dates or venues without prior notice.
• If an emergency prevents the designated instructor from teaching a Training Course, CYCUBIX reserves the right to substitute a qualified replacement. If a suitable replacement cannot be found, CYCUBIX reserves the right to postpone or cancel the Training Course.
• Public Training Courses are subject to minimum numbers. If these are not reached by the specified Registration Deadline date, CYCUBIX reserves the right to postpone or cancel the course.
• CYCUBIX reserves the right to cancel and/or reschedule a Training Course at short notice due to unforeseen circumstances. In such cases, Participants will be notified and entitled to a full refund of the training fees, or the corresponding fees can be credited towards a future Training Course.
• For all bookings, CYCUBIX’s liability shall be limited to the amount of the fee paid to CYCUBIX by the participant.
• No compensation will be paid for any additional costs incurred (for example travel, accommodation, etc.). We therefore recommend that Participants obtain insurance for those costs.

OWNERSHIP AND INTELLECTUAL PROPERTY RIGHTS

• All intellectual property rights in all course materials, including the design, graphics and text of all printed materials and the audio of all webinars and podcasts, are owned by CYCUBIX, or its partners as specified.
• No learning materials content may be copied, reproduced, uploaded, posted, displayed or linked to in any way, in whole or in part, without CYCUBIX’s prior permission.
• By agreeing to these Terms and Conditions, you indicate you understand that the material and content of the course are proprietary to CYCUBIX and its partners and are protected by appropriate intellectual property laws. They have incurred great expense to develop, produce, and present the material and content of the courses.  The material and contents may not be copied, transferred, exchanged, sold, disclosed, or otherwise disseminated to anyone outside the course, and may only be used by you for personal study. Any breach of this license may be grounds for revocation of your certification designation, if awarded, and appropriate legal action.

RECORDINGS

• No photography by Participants is permitted at any time in a course.
• No video or audio recording by Participants is permitted in a course, including the use of mobile phones or other devices for this purpose.
• Live streaming of video or audio by Participants is prohibited in all courses.

INAPPROPRIATE BEHAVIOUR

• In the event of any anti-social behaviour by a Participant, CYCUBIX reserves the right to remove this Participant from the course. No refund will be provided in such cases.

SPECIAL REQUIREMENTS

• CYCUBIX will make every effort to accommodate special requirements that are notified to us in advance on the booking form.

HEALTH AND SAFETY

• Participants must comply with all health and safety rules and regulations and any other reasonable security requirements that apply at the premises at which the Training Course is provided.

TRAINING COURSE DETAILS

• Training Course details, including an outline of the day and venue details will be issued by email prior to the course start date.
• CYCUBIX will not be held responsible for non-receipt of Training Course details and refunds will not be issued under such circumstances.
• Any participant not receiving this information prior to the event should contact us on +353 1 477 3265.

INVITATION LETTERS

• Should a Participant require an invitation letter from CYCUBIX, this can be provided as long as full payment of the training course fee has been received.
• CYCUBIX is not able act on behalf of the Participant and is not responsible for any costs incurred by failure to obtain a full visa.

LIABILITY

• CYCUBIX does not accept responsibility for anyone acting as a result of information in, or views expressed on, its Training Courses including course materials.
• Opinions expressed by trainers in courses are those of the individual trainers and CYCUBIX does not accept responsibility for such opinions.
• NEITHER CYCUBIX NOR ANY OF OUR LICENSORS, SUPPLIERS, ADVERTISERS OR SPONSORS, NOR OUR OR THEIR DIRECTORS, OFFICERS, EMPLOYEES, CONSULTANTS, AGENTS OR OTHER REPRESENTATIVES, ARE RESPONSIBLE OR LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE OR OTHER DAMAGES (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS, LOSS OF DATA OR LOST PROFITS), UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY TO THE SERVICES AND/OR MATERIALS.
• YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICES, MATERIALS OR PRODUCTS AVAILABLE FROM CYCBUIX IS TO STOP USING THE SERVICES, MATERIALS, OR PRODUCTS. THE SOLE AND EXCLUSIVE MAXIMUM LIABILITY TO CYCUBIX FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING WITHOUT LIMITATION, NEGLIGENCE) OR OTHERWISE, SHALL BE THE TOTAL AMOUNT PAID BY YOU TO CYCUBIX IN THE PRECEDING TWELVE (12) MONTHS, IF ANY.
• ALL PRODUCTS AND SERVICES OF CYCUBIX AND OUR PARTNERS ARE SOLD “AS-IS.” UNLESS EXPRESSLY STATED OTHERWISE IN THIS AGREEMENT, CYCUBIX AND OUR PARTNERS DISCLAIM ANY AND ALL OTHER CONDITIONS, WARRANTIES, OR OTHER UNDERTAKINGS CONCERNED WITH THE PRODUCTS AND SERVICES WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW, USAGE, CUSTOM OR OTHERWISE EXCLUDED FROM THIS AGREEMENT, INCLUDING BUT NOT LIMITED TO ALL WARRANTIES, CONDITIONS OR UNDERTAKINGS OF SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, OR FAILURE TO CORRESPOND TO ANY DESCRIPTION OR SAMPLE.
• CYCUBIX DOES NOT GUARANTEE A PASSING SCORE ON ANY EXAM OR COMPLETION OF ANY ENDORSEMENT PROCESS.

PREVAILING TERMS AND CONDITIONS

• Training Courses provided by CYCUBIX are on the basis of these Terms and Conditions.
• These Terms and Conditions are governed by Irish law and any disputes arising regarding these Terms and Conditions shall be subject to the exclusive jurisdiction of the Irish courts.
